In order to acquire protection in Bulgaria from a granted European patent, first and foremost – Bulgaria must have been a designated country in the European patent application and secondly – the granted European Patent must be validated in Bulgaria. Once a granted EP has been validated in Bulgaria, the rights that it confers on its proprietor are the same rights as would be conferred by a granted Bulgarian Patent.

 

Deadline for EP VALIDATION IN BULGARIA

 

The validation of a European Patent in Bulgaria must be completed within a non-extendable term of 3 months following the publication of the decision to grant a European Patent in the European Patent Bulletin. Bearing in mind that Bulgaria has not signed the so-called “London Agreement”, an indispensable part of the process of EP validation in Bulgaria is filing full translation of the European patent description and claims as granted into Bulgarian language with the Bulgarian Patent Office (BPO), coupled with the payment of publication fees.

 

It might as well happen that patent renewal fees must also be paid even earlier in some specific cases, particularly within 2 month period from the granted European Patent, if the respective maintenance fee falls due within the same 2 month term.

 

TRANSLATION OF THE EUROPEAN PATENT INTO BULGARIAN

 

It must be highlighted that pursuant to the Bulgarian Patent Law, in case the Bulgarian translation, as referred above, confers protection, which is narrower than that conferred by the granted European patent, then the text of the Bulgarian translation shall be the authentic text. Hence, it is of paramount importance and also in the interest of all companies that all patent translations are handled by technically competent translators, possessing specific technical background and knowledge in the particular field of technology relevant for the granted European Patent in question.

Appointing a Bulgarian Patent Attorney to validate the granted European Patent in Bulgaria is necessary, if the proprietor of the granted EP has no permanent address or principle place of business in the Republic of Bulgaria.

The Bulgarian Patent Office conducts publication of the validated European Patents (EP) in its Official Bulletin and issues EP validation certificate.

Forwarding the EP validation certificate to the client

The EP validation certificate is forwarded to the client without undue delay upon its receipt from BPO. It can be either sent electronically as a scanned copy or as a hard copy. This is the final step of the European Patent Validation process in Bulgaria.

EP RENEWAL FEES

EVERY YEAR

In order to keep the granted and validated European Patent valid for the territory of Bulgaria, patent renewal (maintenance) fees must be annually paid to the Bulgarian Patent Office. Failure to observe the due date for payment of renewal fees will lead to a lapse of the European Patent for the territory of Bulgaria. Anyone can then commercially exploit the subject matter of the patent without infringing any rights outstanding.
